Supplemental Terms for Delivery Partners and Merchants
Effective Date: 18th November 2026
PART I — SMARTDASHER TERMS
1. SmartDasher Platform
SmartDasher provides technology through which approved delivery partners may receive and complete eligible delivery opportunities.
Access to SmartDasher is subject to verification, operational requirements, applicable law and SmartDash policies.
2. Dasher Eligibility
A Dasher must provide truthful, accurate and current information.
Depending upon the delivery service performed, SmartDash may require:
- identity verification;
- valid identification;
- driver's licence;
- vehicle documentation;
- insurance documentation;
- telephone verification;
- profile photograph;
- banking or mobile-money information;
- eligibility documentation; and
- other information reasonably necessary for safety, legal or operational purposes.
Submission of false or fraudulent documentation may result in immediate restriction or termination.
3. Independent Service Relationship
Unless a separate written employment agreement expressly provides otherwise, the SmartDasher platform is intended to facilitate services performed by independent delivery partners rather than establish employment merely by use of the application.
However, the legal classification of any relationship remains subject to applicable Ghanaian law and the actual circumstances of the relationship.
Nothing in these Terms is intended to unlawfully deprive a Dasher of rights that cannot legally be waived.
4. Delivery Decisions
Subject to applicable operational requirements and law, Dashers may determine whether to accept available delivery opportunities.
Acceptance of a delivery creates an obligation to make reasonable efforts to complete it safely, lawfully and according to the information provided through SmartDash.
5. Safety
Dashers must:
- comply with applicable traffic laws;
- operate vehicles safely;
- maintain legally required licences;
- maintain required vehicle documentation;
- avoid dangerous driving;
- avoid operating a vehicle while impaired;
- handle customer orders appropriately; and
- avoid conduct that puts customers, merchants or members of the public at unreasonable risk.
6. Customer Privacy
Customer information supplied to a Dasher is provided only for legitimate delivery purposes.
A Dasher must not:
- retain customer information unnecessarily;
- sell customer information;
- publish customer information;
- use customer details for unrelated marketing;
- contact customers for unrelated personal purposes;
- share customer addresses with unauthorised persons; or
- attempt to circumvent SmartDash privacy safeguards.
Delivery addresses, telephone-routing information and other customer data must be treated as confidential.
7. Location Information
SmartDasher may require location access to provide core functionality.
Depending upon application configuration, location information may be processed while a Dasher is online, available for delivery opportunities or completing a delivery.
Location information may support:
- assignment of nearby deliveries;
- navigation;
- delivery tracking;
- estimated arrival times;
- safety;
- fraud prevention;
- delivery verification; and
- dispute resolution.
Location processing remains subject to the SmartDash Privacy Policy and applicable law.
8. Delivery Integrity
Dashers must not:
- falsely mark orders as delivered;
- steal customer orders;
- intentionally damage orders;
- manipulate GPS information;
- use unauthorised software to manipulate SmartDash;
- falsify delivery evidence;
- share accounts with unauthorised persons;
- create fraudulent deliveries;
- intentionally inflate delivery charges; or
- engage in collusion designed to defraud SmartDash, merchants or customers.
9. Account Sharing
A SmartDasher account is personal to the verified account holder unless SmartDash expressly authorises another arrangement.
A Dasher must not allow an unverified person to perform deliveries through the Dasher's account where verification is required.
10. Earnings and Payouts
SmartDash will make available information concerning applicable delivery earnings, fees or incentives according to the payment structure then in effect.
Dashers are responsible for reviewing their payment information and promptly reporting suspected discrepancies.
Payment may be withheld temporarily where reasonably necessary to investigate suspected fraud, chargebacks, account compromise or unlawful activity, subject to applicable law.
11. Taxes
Unless SmartDash is legally required to deduct, withhold or remit a particular tax or statutory payment, Dashers remain responsible for taxes and obligations legally applicable to their earnings.
12. Equipment and Expenses
Responsibility for vehicles, fuel, mobile devices, mobile data, maintenance, insurance and other expenses will be determined by the applicable SmartDasher program, written agreement and Ghanaian law.
13. Ratings and Complaints
SmartDash may collect customer and merchant feedback concerning delivery quality.
A serious safety complaint, fraud allegation or repeated service failure may result in investigation.
SmartDash should not treat a single unverified complaint as conclusive proof of misconduct without reasonable investigation where circumstances warrant review.
14. Suspension and Deactivation
SmartDash may restrict or deactivate a Dasher account for reasons including:
- fraudulent activity;
- false identity documents;
- theft;
- serious safety violations;
- customer harassment;
- merchant harassment;
- misuse of personal data;
- account sharing;
- manipulation of the platform;
- repeated material delivery failures; or
- conduct creating significant legal, security or reputational risk.
Emergency restrictions may be imposed immediately where reasonably necessary to protect people, property or the platform.
15. Accidents and Incidents
Dashers should promptly report serious accidents, injuries, thefts, threats, damaged orders or safety incidents occurring in connection with a SmartDash delivery.
SmartDash may request reasonable supporting information for investigation, insurance, safety or legal purposes.
