SMARTDASH USER TERMS AND CONDITIONS
For Customers Using the SmartDash Platform
Effective Date: 18th November 2026
Last Updated: 2nd September 2026
1. Agreement
These Terms and Conditions (“Terms”) constitute an agreement between you and SmartLogic Tech concerning your access to and use of SmartDash.
By creating an account, placing an order or otherwise using SmartDash, you agree to these Terms and the SmartDash Privacy Policy.
If you do not agree, you must not use SmartDash.
2. SmartDash Platform
SmartDash provides technology that facilitates transactions and interactions among customers, participating merchants and delivery partners.
The precise contractual role of SmartDash in individual transactions may depend on the particular service being provided and applicable law.
3. Account Eligibility
Users must provide accurate information when creating or maintaining an account.
You are responsible for:
- maintaining the security of your account;
- protecting authentication credentials;
- maintaining an accurate telephone number and email address;
- preventing unauthorised use of your account; and
- notifying SmartDash promptly of suspected account compromise.
You may not impersonate another person or create an account using information you are not authorised to use.
4. Orders
An order submitted through SmartDash constitutes a request to purchase goods or services from the selected merchant and, where applicable, obtain delivery services.
Orders may be subject to merchant acceptance, availability, payment confirmation, geographic limitations and operational capacity.
SmartDash does not guarantee that every submitted order will be accepted.
5. Prices and Fees
Before confirming an order, SmartDash may display applicable:
- item prices;
- delivery fees;
- service fees;
- taxes or statutory charges;
- small-order fees;
- priority or special-service fees;
- discounts; and
- other disclosed charges.
The customer is responsible for reviewing the total amount before confirming an order.
6. Payments
Customers authorise SmartDash and/or its designated payment provider to process amounts properly due in connection with an order.
Payment processing may be performed by banks, mobile-money operators or authorised payment providers.
SmartDash may cancel, hold or investigate a transaction where fraud, unauthorised activity or payment irregularities are reasonably suspected.
7. Cancellations and Refunds
The SmartDash Return, Refund and Cancellation Policy forms part of these Terms. It explains customer cancellations, unavailable orders, item problems, returns, replacement requests, credits and refunds.
Before a customer confirms a voluntary cancellation in the app, SmartDash displays the cancellation stage, any applicable deduction or compensation and the estimated refund. The calculation may depend on:
- whether the cancellation is made within the first five minutes;
- whether preparation has started;
- whether the merchant has marked the order ready;
- whether a Dasher has been dispatched;
- whether products have been collected;
- the reason for cancellation;
- applicable law.
Under the current SmartDash rules, a ready merchant may qualify for compensation equal to twenty per cent of the order total, and an accepted SmartDasher may qualify for compensation equal to ten per cent. If the SmartDasher has collected the package, that compensation remains pending until the required return to the merchant is verified. The order-specific quote shown before confirmation controls the voluntary cancellation calculation.
A customer is not automatically entitled to a full refund after goods have been prepared, collected or delivered merely because the customer changes their mind. This does not affect remedies for missing, wrong, damaged, unsafe or materially defective goods, an unfulfilled transaction or another claim protected by law.
If a fee, deduction or compensation would conflict with a mandatory consumer remedy, the applicable legal requirement controls.
8. Delivery
Customers must provide complete and accurate delivery information.
Customers should:
- provide a reachable telephone number;
- provide accurate location information;
- provide appropriate delivery instructions;
- remain reasonably available when delivery approaches; and
- provide safe and lawful access to the delivery location.
Additional costs or cancellation consequences may apply where delivery cannot reasonably be completed because the customer provided incorrect information or was unavailable, subject to applicable law and SmartDash policies.
9. Delivery Estimates
Times displayed by SmartDash are estimates unless expressly stated otherwise.
Delivery may be affected by:
- traffic;
- weather;
- merchant preparation time;
- road conditions;
- accidents;
- security conditions;
- demand;
- vehicle problems;
- incorrect addresses;
- telecommunications outages; and
- events outside reasonable control.
10. Customer–Dasher Communications
SmartDash may provide communications functionality allowing customers and Dashers to contact one another concerning active deliveries.
Users must not use this functionality to:
- harass;
- threaten;
- discriminate against;
- intimidate;
- solicit improperly; or
- abuse another person.
Where SmartDash provides number-masking or communication-routing technology, users must not attempt to bypass that protection to obtain another user's private telephone number without authorisation.
11. Prohibited Conduct
Users must not use SmartDash to:
- commit fraud;
- steal;

Customers should report incorrect, missing, damaged or materially defective orders through SmartDash's available support channels.
14. Food Allergies and Dietary Requirements

Ingredient and allergen information may originate from merchants.
SmartDash does not manufacture or prepare merchant food products unless expressly identified otherwise.

17. Platform Availability
SmartDash does not guarantee that its technology will operate without interruption.
Maintenance, telecommunications problems, third-party outages, cybersecurity events and other circumstances may temporarily affect availability.
18. Limitation of Liability
To the maximum extent permitted by applicable law, SmartDash and SmartLogic Tech will not be responsible for indirect, incidental, consequential or purely economic losses arising from circumstances outside SmartDash's reasonable control.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable Ghanaian law, including liability arising from fraud or other liability that cannot legally be waived.

22. Changes to Terms
SmartDash may amend these Terms when reasonably necessary because of changes to law, technology, security requirements, services or business operations.
Where appropriate, material changes will be communicated to users.
Continued use after the effective date of updated Terms may constitute acceptance where permitted by law.
23. Governing Law
These Terms are governed by the laws of the Republic of Ghana, without prejudice to mandatory rights or protections that applicable law provides to users.
24. Dispute Resolution
Users should first contact SmartDash Support to allow SmartDash a reasonable opportunity to investigate and resolve a complaint.
Nothing in these Terms prevents a user from exercising rights before a competent regulator, tribunal or court where applicable.
25. Severability
If a competent authority determines that a provision of these Terms is unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
